Pursuant to Article 88 of the Constitution of the Republic of Croatia, I hereby issue the

DECISION

PROMULGATING THE ACT ON THE AMENDMENTS TO THE ACT ON REFERENDUM AND OTHER FORMS OF PERSONAL PARTICIPATION IN THE PERFORMANCE OF STATE POWERS AND LOCAL AND REGIONAL SELF-GOVERNMENT

I hereby promulgate the Act on the Amendments to the Act on Referendum and Other Forms of Personal Participation in the Performance of State Powers and Local and Regional Self-government passed by the Croatian Parliament at its session on 20 March 2009.

ACT

ON THE AMENDMENTS TO THE ACT ON REFERENDUM AND OTHER FORMS OF PERSONAL PARTICIPATION IN THE PERFOMANCE OF STATE POWERS AND LOCAL AND REGIONAL SELF-GOVERNMENT

Article 1

In the Act on Referendum and Other Forms of Personal Participation in the Performance of State Powers and Local and Regional Self-government (Official Gazette “Narodne Novine”, No. 33/96 and 92/01) in Article 12 the words “State Referendum Commission” are replaced by the words “State Election Commission of the Republic of Croatia”.

Article 2

In Article 14, paragraph 1 the words “and in the City of Zagreb” are inserted after the words “in the county”.

Paragraph 2 is amended to read:

"The president, vice-president, members and deputy members of the state referendum commission in a county, i.e. in the City of Zagreb, shall be appointed by the State Commission selected from among the judges with permanent residence in the respective county, i.e. in the City of Zagreb”.

In paragraph 3 the words: “in the City of Zagreb” are deleted.

In paragraph 4 the words “City of Zagreb” are deleted.

Article 3

In Article 17, paragraph 1, subparagraph 2 the words “City of Zagreb” are deleted.

Article 4

After Article 17, Article 17.a is added which reads:

“Article 17.a

The State Referendum Commission in the City of Zagreb shall:

– ensure that a state referendum in the City of Zagreb is conducted in accordance with the law,

– make all technical preparations required for the purpose of conducting a state referendum in accordance with the binding instructions of the State Commission,

– determine polling stations and appoint committees in the City of Zagreb,

– collect and sum up the voting results from the polling stations in the City of Zagreb and submit them to the State Commission,

– conduct other tasks under this Act”.

Article 5 In Article 18 the words “City of Zagreb” are deleted.

Article 6 In Article 21, paragraph 2 and paragraph 3 the words “City of Zagreb” are deleted.

Article 7 In Article 28 the words “minister of maritime affairs, transport and communications” are replaced by the words “minister of sea, transport and infrastructure”.

Article 8

In Article 29 the words “minister of justice, public administration and local self-government” are replaced by the words “minister of justice”.

Article 9 In Article 41 the words “City of Zagreb” are deleted.

Article 10 In Article 42, paragraph 1 is amended to read:

"State referendum commissions in a county, i.e. in the City of Zagreb, shall be obliged to establish referendum results in a county, i.e. in the City of Zagreb”.

In paragraph 3, subparagraph 1 the words “in a county” are followed by the words “i.e. in the City of Zagreb”.

Article 11 Article 48 is amended to read:

»Financial assets required for the purpose of conducting a local referendum shall be ensured in the budget of the respective local self-government unit, i.e. regional self-government unit in which a local referendum is to be held.

Financial assets for the purpose of conducting local citizens´ meetings shall be ensured in the budget of the respective local self-government unit, i.e. in the budget of the City of Zagreb.

The remuneration of the president and members of a commission in charge of conducting a local referendum, which cannot exceed the average monthly salary in the Republic of Croatia, shall be determined by a county prefect, the Mayor of the City of Zagreb, a mayor or a municipality head”.

Article 12 In Article 53, paragraph 2 is amended to read:

»In case the State Commission dissolves a county committee, i.e. the committee of the City of Zagreb, it shall appoint a new committee, and in case it dissolves a city, i.e. municipal committee, it shall request from the respective county committee to appoint a new committee in a town or municipality, i.e. request from it to dissolve the committee and appoint a new one”.

Article 13

In Article 54, paragraph 2 the words “of the City of Zagreb” and “in the City of Zagreb” are deleted.

Article 14

This Act shall be published in the Official Gazette, and shall enter into force on the day of the entry into force of the decision on announcing the first following general and regular elections of members of municipality and city councils, county assemblies and the City Assembly of the City of Zagreb as well as of municipality heads, mayors, county prefects and the Mayor of the City of Zagreb.
