The National Electoral Commission shall immediately submit the statement of the candidate, referred to in Article 40a, paragraph 5, to the Court of Appeal in Warsaw. The court shall institute "ex officio" of the lustration proceedings.
If the statement referred to in Article 40a paragraph 1 were submitted earlier, as a result of candidacy to the public office to which such obligation was connected, the candidate for the President of the Republic shall inform of that fact, in writing, the National Electoral Commission.
