Paragraph 59

Some provisions in the law, such as Articles 36, 93, and 138, permit cancellation of candidate registration.  These provisions represent two risks.  First, there is no formal guarantee that the minimum legal safeguards required by international standards, OSCE commitments, and the Constitution of Moldova, will be applied.  Secondly, to the extent that Article 36 would permit post-election cancellation of candidate registration, which would include cancellation of the registration of an elected candidate, this would result in a violation of Paragraph 7.9 of the 1990 OSCE Copenhagen Document (hereafter the Copenhagen Document).
