Paragraph (2) of Article 93 bars candidates who have “committed fraud” from participating in repeat elections held two weeks later. Such a rule would also pose problems with regard to the above-mentioned principle of presumption of innocence and fair trial. Actually, it is highly unlikely that the full panoply of legal safeguards available to a candidate will have been exhausted in two weeks, in a manner that is consistent with these principles. This concern also applies to Article 138.
