Paragraph 90

The powers of the courts in solving the contestations against constituency councils and electoral offices of polling stations are not set out. It is not clear, what the court might decide: does it have the right to annul the results of elections in the polling station or constituency council? Such a power would not be in accordance with the power of the Court of Appeal to confirm the results based on the report by the CEC (Article 71 (2)). In the latter case, political parties, citizens or candidates are not allowed to contest the results; the contestations might still be pending before the courts by the time the results are confirmed according to the time limits set out in Article 71 (3).
