Article 218
 

(Procedures for Voting of Overseas Election)


(1) A person who has filed an overseas absentee report or an overseas elector who has filed an application for the registration of the overseas elector by 
the method specified Article 218-5 (1) 1 or 2 shall make an appearance in the relevant overseas polling place, produce the ballot paper, the envelop for dispatch, and the envelop for return, which he/she received from the competent Gu/Si/Gun election commission, along with his/her identification certificate (referring to a certificate issued by a government office or public institution of the Republic of Korea with his/her photo affixed thereon, with which he/she can be identified, such as a passport, resident registration certificate, certificate of public official, driver’s licence, or a certificate issued by the government of the country in which he/she sojourns with his/her photo affixed thereon and his/her name and date of birth stated therein, with which he/she can be identified) before the members of the competent overseas election commission and voting witnesses to have his/her identity verified, enter a balloting booth to write the name of a candidate (limited to a presidential election and an election for National Assembly members from constituencies) or the name or mark of a party on the ballot paper, put the paper in an envelope for return, seal the envelope, and then put the envelope in a ballot box before voting
witnesses.

(2) An overseas elector who has filed an application for the registration of the overseas elector by the method specified in Article 218-5 (1) 3 shall
produce the original set of the document publicly announced pursuant to Article 218-5 (3) by the official in charge of overseas voting management
in the diplomatic or consular mission having jurisdiction over the area in which the elector resides to have his/her nationality and identify verified
and then cast a vote pursuant to paragraph (1) but shall produce an identification certificate specified in paragraph (1), if the document so produced has no photo with which he/she can be identified.

(3) A ballot paper on which the name of a candidate or the name or mark of a party has been written in advance before casting a vote at an overseas polling place shall be invalid.

(4) Where ballot papers are prepared and delivered pursuant to Article 218-18 (3) or (4), notwithstanding paragraph (1), a responsible member of an
overseas polling place shall confirm the identification of an overseas elector, etc. and then deliver a ballot paper and an envelope for return to the overseas elector, etc. by the use of the overseas electoral register, etc. received under Article 218-13 (3).

(5) Matters regarding the delivery of ballot papers, procedures and methods for voting under paragraph (4) and other necessary measures shall be
prescribed by Regulations of the National Election Commission.
