C. Election Commissions


Article 26(3) contains a detailed list of the persons who cannot be members of DECs or PECs. It prohibits people who have committed deliberate crimes from being election commission members. This restriction would appear to be overly broad and not proportionate as in the case of passive suffrage rights. Consideration should be given to changing this section to reflect a connection between the type and severity of the crime committed and the duties related to being a member of an election commission.
