In its case 2016/117 of 3 June 2016 the Constitutional Court dealt with a request to consider the constitutional amendment of 12 April 2016 as a parliamentary decision on the lifting of immunity under Article 83 of the Constitution, which can be controlled by the Constitutional Court under Article 85 of the Constitution. On this basis, the petitioners argued that their right of defence was not respected because they had not been heard in the procedure of lifting of immunity as foreseen in Article 83 of the Constitution and the Rules of Procedure of the National Assembly.
