In the opinion of the Venice Commission, there is clearly a danger that democratic process will be encumbered when there are restrictions on the ‘normal’ rule of law processes. There is also a risk that fundamental electoral principles will be undermined during a state of emergency, in particular the principle of equality of opportunity. Similarly, it is axiomatic that derogation from individuals’ civil and political rights creates a risk that the results are not democratic.
