Article 78
 

Advertising Panels and Billboards


(1) Political advertising on advertising panels and billboards shall be permitted.
(2) The maximum number of advertising panels and billboards from paragraph (1) of this article that may be used for political advertising amounts to 50% of their total number on the territory of a particular municipality, City of Skopje, or on the territory where they are managed by a particular legal entity.
(3) The political parties have the right to rent advertising panels and billboards for political advertising in a transparent and non-discriminatory manner, in line with the following criteria:


- 40% of the total number shall be available to the ruling parties;
- 40% of the total number shall be available to the opposition parties;
- 10% of the total number shall be available to the parliamentary parties that have no parliamentary groups in the Parliament of the Republic of Macedonia; and
- 10% of the total number shall be available to the non-parliamentary parties in the Republic of Macedonia.


(4) Municipalities in the Republic of Macedonia, the City of Skopje and the legal entities that manage the advertising panels and billboards shall publicly announce the location and the rental prices for the advertising panels and billboards within five days of the day of the announcement of the elections. The price cannot be changed during the election process and it cannot exceed the average rental price calculated in the three months preceding the day of the announcement of the elections.
(5) The municipalities in the Republic of Macedonia, the City of Skopje and the legal entities that manage the advertising panels and billboards shall distribute the locations available for political advertising according to the criteria from paragraph (3) of this article, by drawing of lots.
(6) The lot drawing from paragraph (5) of this article shall be conducted by the State Election Commission of the Republic of Macedonia.
(7) If a political party or a coalition fails to make use of the total percentage of advertising panels and billboards available for rent or the locations distributed by drawing of lots, the remaining political parties have the right to rent them.
