A justification advanced by the President in his Reasons for postponing the election is a violation of the right to vote according to Article 3 of the First Protocol to the European Convention on Human Rights, by conducting elections in which there is no real political choice. In this respect, the President refers to the Case of Riza and others v. Bulgaria of the European Court of Human Rights of 13 October 2015.33 That case concerned the decision of the Bulgarian Constitutional Court to annul the election results in 23 polling stations set up outside the country (in Turkey) during the 2009 Bulgarian general elections. The Court came to the conclusion that the right to vote in and to stand for general elections under Article 3 of Protocol No. 1 to the Convention had been violated by Bulgaria.
