Paragraph 109

109.  On the related point, the right to be elected would be denied if a person has received a final court sentence of imprisonment for not less than six months.[81] It is unclear whether the right is withdrawn permanently or only during the period of the sentence. If the right to stand for election is withdrawn for a longer period, a question of proportionality may arise, and also whether this determination should not rather be subject to the decision of the voters.
