Although not uncommon in the region, the Election Code contains a prohibition for judges and assistants to judges to become members of the CEC or the DECs (Art. 18.6 h). It might be sensible to reconsider such a provision. In some new democracies, the incorporation of judges into the electoral commissions contributes towards strengthening professionalism and impartiality. It should be remembered that the “Code of Good Practice in Electoral Matters” of the Venice Commission also recommends that the central electoral commission should include at least one member of the judiciary (CDL-AD (2002) 23rev.).
