Article 20(9) mandates the National Commission on Television and Radio (NCTR) to monitor the campaign for compliance with media pre-election requirements. The Constitutional Court found that the NCTR failed to discharge its duty under this section. The Code should be amended to provide specific guidelines that would ensure that the NCTR does fulfil its mandate, and that candidates and political parties have their rights to equal access to the media realised during a campaign, and have a clear remedy available in the event that their rights are infringed.
