Article 84(5) of the Code provides:  “The total airtime for political advertisements, during the whole electoral campaign, by each private radio and television station may not be more than 45 minutes for each party that has obtained up to 20 percent of the seats in the Assembly and 90 minutes for each party that has obtained more than 20 percent of the seats in the Assembly.”  Article 84(5) raises a question of compatibility with the principle that political advertising must be allowed to all electoral participants under equal conditions.  The Venice Commission and the OSCE/ODIHR recommend that Article 84(5) be amended to provide that all political parties and candidates have the possibility of buying political advertising according to equal conditions and rates of payment.
