B. Decision making of the election commissions









If the requirement of a qualified majority is maintained, more precision would be suitable as to its scope. Among the decisions for which Article 24 of the Code provides for a qualified majority in the CEC are “acts of a normative nature that aim to regulate issues related to elections”. The requirement of a qualified majority for acts of a normative nature may be justified as these decisions establish legal norms and need to be adopted collegially. It is, however, noteworthy that neither the Code nor the Code of Administrative Procedures contains any definition of a normative act. During the 2011 local elections, the normative nature of several CEC acts was seriously disputed between the majority-appointed and minority­appointed members of the CEC.
