If there are alleviative circumstances, the courts are authorized to exchange a sanction of penitentiary against a prison sentence of at least 3 months, and reduce the imprisonment to less than 8 days and a fine below 26 euros.
They may pronounce separately one or the other of theses punishments without them being higher than the police’ punishments.
