Where any person upon whom any functions or duties are conferred by or under this Act in relation to a Dáil election fails without reasonable cause to perform his functions or duties in that behalf, any person injured by such failure shall be entitled to recover from him by action at law such sum by way of damages as the court by which such action shall be tried shall consider just.
