The explanatory memo to the draft proposal points to Article 69 (2) of the Constitution as a basis for allowing the recall of mandates. According to this provision, the mandate of an MP ceases “… on withdrawal of the mandate…”. The explanatory memo furthermore points to a judgement by the Constitutional Court on the interpretation of Article 69.
