The system for the allocation of seats for the House of Peoples of the Federation is governed by norms from two levels. On the Entity level, Article IV.8(3) of the Constitution of the Federation provides that if a canton has any delegate in its cantonal assembly from a particular constituent people, then that canton must send a representative of that constituent people to the House of Peoples of the Federation. On the State level, Article 10.12(2) of the Election Law of BiH provides that each canton must send a minimum of one delegate from each constituent people. This leads to the question of which norm prevails.
