In any case, whatever the conditions and modalities for implementing norms of international law in a country, a State remains bound by international law. Indeed, pursuant to Article 27 of the Vienna Convention on the Law of Treaties, “[a] party may not invoke the provisions of its internal law as justification for its failure to perform a treaty”. Consequently, it should also be borne in mind that the reference to the “highest values” listed in the new Article 1 of the Constitution cannot be invoked to justify non-compliance with provisions of a treaty ratified by the Kyrgyz Republic.
