Paragraph 44

The jurisdiction of the Constitutional Chamber is currently set out in Article 97 of the Constitution. Under this provision, the Constitutional Chamber is responsible for performing constitutional oversight, which, according to Article 97 par 6 shall involve reviewing the constitutionality of laws, international treaties, and draft laws. If these are found to be unconstitutional, then the Constitutional Chamber has the power to declare these instruments unconstitutional, and thus to repeal them (Article 97 pars 6 and 9). Paragraph 7 of Article 97 also foresees the possibility of individual constitutional complaints, which everyone may initiate in case he/she believes that certain laws or other regulatory acts violate the rights and freedoms recognised in the Constitution.
