Article 35.2 of the draft law provides for an approval quorum of 25% of registered voters. Pursuant to the Code of Good Practice on Referendums “[i]t is advisable not to provide for b) an approval quorum […] since it risks involving a difficult political situation if the draft is adopted by a simple majority lower than the necessary threshold”. This quorum which appears in Article 207 of the Constitution, is therefore not in line with the Code of Good Practice on Referendums.
