Article 142
 

There is, for the whole of Belgium, a Constitutional Court whose composition, competence and functioning are determined by law.


This Court rules by judgment on:


1 ° the conflicts referred to in section 141;


2 ° the violation by law, decree or rule referred to in article 134, articles 10, 11 and 24;


3 ° the violation by a law, a decree or a rule referred to in article 134, of the articles of the Constitution that the law determines.


The Court may be seised by any authority designated by law by any person proving an interest or, for a preliminary ruling, by any court.


The Court shall rule by decision on each popular consultation referred to in Article 39bis, prior to its organization, under the conditions and according to the procedures laid down by law.


The law may, in the cases and under the terms and conditions it determines, confer on the Court the power to give a decision, by judgment, on appeals lodged against the decisions of the legislative assemblies or their election expenses for the elections to the House of Representatives.


The laws referred to in paragraph 1, paragraph 2, 3 ° and paragraphs 3 to 5 shall be adopted by the majority provided for in the last paragraph of Article 4.
