During the last phase of the impeachment procedure, the Constitutional Court decides as a plenary (Article 62 of the Law on The Constitutional Court). As a consequence, the Constitutional Court must be established and have a quorum of at least six judges (Article 32 of the Law on the Constitutional Court). A majority of five judges is required to decide on impeachment (Article 74(4) of the Law on the Constitutional Court). This means that the impeachment of the President cannot happen until the Constitutional Court has at least six judges. Currently, the Court has only one judge and it seems that the appointment of four judges is under way.
