In the view of the Venice Commission, prisoners should be allowed to exercise their right to vote without restrictions unless imposed as part of the penalty for the offence by the court of law. In pronouncing such sanctions the principle of proportionality and necessity of a such sanction in a democratic society should be respected. Criminal penalty leading to imprisonment should not mean an automatic deprivation of one of the most important political rights - the right to vote.
