According to the European Court of Human Rights (and the former European Commission on Human Rights), a residence requirement is not an arbitrary restriction of the right to vote and is therefore not incompatible with Art. 3 of Protocol No. 1 of the ECHR. Correspondingly, the Code of Good Practice in Electoral Matters stipulates that a residence requirement may be imposed (CDL-AD(2002)023rev2-cor, part I 1.1c).
