Amendments to Section 45 of the Act on Electoral Procedure (Section 18 of the Act) elaborate on the decision-making process of election commissions. They provide that the content of the proposal for a decision is to be determined and presented by the president of the election commission or a member appointed by them; the president oversees the technical input involved in preparing the proposals for decisions. If the proposal for a decision is rejected by a commission, in order to prepare a new proposal, the president may adjourn the meeting or request postponement of the decision to a new date within the time limit for making a decision, the postponement to be decided by the commission. These provisions provide further clarity and transparency in the decision-making of the commissions. However, the Venice Commission and ODIHR recommend, in line with previous recommendations, providing commission members with the opportunity to contribute to the formulation of draft decisions or to submit alternative drafts for deliberation, to contribute to the inclusivity of the process.
