However, the Venice Commission recommends extending literally the requirement to ensure the conformity of the subject of referendums with the Constitution (Article 48 (2)) to all infraconstitutional referendums, in conformity with the principle of the Rule of Law. The decision on the issue - to be taken before submitting the question to referendum - should be open to judicial review.
