The ECtHR has clearly pointed to the responsibility of the state for preventing inequality in media coverage during elections online and offline, however with significant differences as regards the influence between traditional media and new media. The issue at stake now is how to define those differences precisely – whether they have already reached a “sufficiently serious shift in the respective influence”. The crucial caption of the momentum of this ‘shift’ is to determine whether the positive responsibility of the state in assuring equal exposure of political parties and candidates are to be applied to new information intermediaries and in what manner.
