Finally, the Commission underlines that elections held in the territories beyond the internationally recognized borders would have difficulties to comply with many of the applicable standards (distortion of the results of the elections by the participation of persons who would not have the right to vote under normal circumstances; lack of respect for fundamental human rights; absence of electoral observers; failure to abide by certain procedural guarantees etc.). Furthermore, it is difficult to determine whether the inhabitants of the territory which was unlawfully annexed have validly acquired the nationality of the annexing State, i.e. whether their nationality is opposable to third states on the international plane. This fact casts doubts on their eligibility for participation in national elections and might contribute to the distortion of the electorate.
