Under the draft amendments, Article 21 of the Election Code that covers DEC powers has been expanded to include additional circumstances under which a recount of ballot papers from an electoral precinct must be automatically conducted by a DEC. In this respect, the draft law adds two specific circumstances: when the sum of the number of ballot papers deemed void and the number of ballot papers given to voters as recorded in the summary protocol of the voting results drawn up by a PEC (1) exceeds the total number of voters participating in the election by 5 or more than 5 or (2) is less than the total number of voters participating in the elections by 10 or more than 10. These changes, which are in line with the advice provided by ODIHR and the Venice Commission in their April 2021 Joint Opinion, could serve to enhance the credibility of election results and may bolster public trust in the electoral process.
