57. Article 23 generally captures the essence of the abuse of administrative resources provided by international standards.50 However, as per good practice, the legal framework should ensure an effective balance between the realisation of individual rights for participation in political and public life and the collective interests in the integrity of public resources, accountable and ethical electioneering, and equality of opportunity. Allowing high-ranking officials to use resources, for security reasons, during election campaigns might still undermine the principles of equality, especially where the use exceeds the necessity of such security resources. In line with previous recommendations,51 the Venice Commission and ODIHR recommend that consideration be given to further reviewing the provision to prescribe stricter rules for the use of administrative resources even for the officials requiring state protection. Besides the legal framework, this could be done by increasing political efforts aimed at preventing the misuse of state positions and public resources during electoral processes. In addition, it should be made clearer what sanctions will apply in case these provisions are violated.
