Article 57
 

Liability for Violation of the Election Rights of Citizens

Persons:

1) who by means of violence, fraud, threats, forgery or in another manner interfering with free implementation by the citizen of the Kyrgyz Republic of the right to elect and to be elected, or violating the secrecy of voting, the right of citizens to get familiarized with the electoral register, or forcing citizens or preventing them from putting their signatures in support of a candidate, as well as persons involved in forgery of signatures or bribing of voters;

2) Those who make use of their official or business position to get elected, or have failed to timely collate or update information on the registered voters (electoral registers) before delivering this information to respective election commissions, or who violate the rules of financing of elections, including persons who delay transfer of funds to election commissions, to candidates, political parties, election blocs, or those who have issued ballots to citizens in order to provide them with a possibility to vote for other electors; or those who have committed forgery of election documents, have composed and issued deliberately false documents, have performed deliberately wrong counting of votes or establishment of the results of elections, have failed to submit or failed to publish the results of voting in contradiction with their official responsibilities;

3) those who spread deliberately false information on candidates or committing other actions, damaging the dignity and honour of candidates, of their close relatives or representatives, or violate the rights of election commission members, observers, foreign (international) observers, proxy persons of candidates, political parties, election blocs, mass media, including the right to obtain timely information and copies of election documents, those, who without proper motivation refuse to register foreign and domestic observers, candidates, proxy persons, political parties, election blocs, mass media representatives, those who hinder implementation of election rights at the polling stations, or violate the rules for conduct of the election campaign, including those who conduct campaigning on the day previous to the election day and on the election day; or those who prevent or illegally interfere into the work of election commissions in the course of execution of their responsibilities; those who brought the ballots outside the polling station, or fail to submit or fail to publish the reports on spending funds for preparation and conduct of elections, financial statements of the election funds of candidates, political parties, election blocs and financial reports on spending of budget funds allocated for conduct of elections, and also employers who refuse to provide the leave stipulated by law for participation in elections, shall bear criminal, administrative or other liability in accordance with the laws of the Kyrgyz Republic.
