Some of the provisions could be applied to impede impartiality and accountability in the election administration. Article 17.1 states that “the election administration of Georgia is a legal entity of public law”. This text could be interpreted to mean that accountability is based on the “collective” conduct of the election administration, as opposed to individual acts of commissioners. It is recommended that it be verified that this text does not affect the right to maintain legal actions by or against individual commissions or commissioners.
