As noted earlier, Article 40a of the Law on Parliamentary Elections requires that a certain percentage of the candidates on an electoral list be of the gender less represented on the list. Article 42 of the Law on Local Elections has a similar, but not identical provision. Article 42 requires that “every fourth seat shall be allocated to a person of less represented sex in the list” from “the remaining two-thirds of seats”.[15] The gender requirement of Article 42 is less significant than the gender requirement of Article 40a of the Law on Parliamentary Elections. The OSCE/ODIHR and the Venice Commission recommend that consideration be given to harmonizing these two articles so that the gender requirements for electoral lists are consistent with each other.
