The Joint Recommendations stressed the need that any proceedings that should lead to such a sanction should abide by the principle of presumption of innocence. The Code should also specify that such decisions should not lead to the cancellation of the mandate of an elected candidate. No amendment has been entered to the mentioned norms. It can be assumed that the existing norms can, and indeed have to be, interpreted in a way that is consistent with the intended principles.
