 According to Article 13(1)c, “those sentenced to imprisonment by a final decision by a court of law” do not have the right to vote. The last Joint Opinion emphasised that infinite cancellation of voting rights of individuals sentenced to imprisonment, regardless of the reason or the seriousness of the offence, was not in line with recent jurisprudence of the European Court of Human Rights (ECHR). According to the ECHR, restrictions of the right to vote affecting all convicted prisoners in a general, automatic and indiscriminate manner are incompatible with Article 3 of the First Protocol (Right to free elections) to the Convention for the Protection of Human Rights and Fundamental Freedoms.[28]
