And yet, the infinite cancellation of voting rights that is stipulated for people that have been sentenced to imprisonment, regardless of the reason or the seriousness of the offence, is not acceptable. In addition, it is not certain that the formulation of Article 13.1.c according to which “those sentenced to imprisonment by a final decision of a court of law” cannot vote is in line with a recent jurisprudence of the European Court of Human Rights, who ruled that restrictions of the right to vote affecting all convicted prisoners in a general, automatic and indiscriminate manner, were incompatible with Article 3 of the First Protocol (Right to free elections) to the Convention for the Protection of Human Rights and Fundamental Freedoms.[30]
