89. A judge should not sit in review of a decision in which the judge participated as a commission member.[16] Safeguards must be added in the law to address the situation where members of the judiciary are also serving on election commissions. The OSCE/ODIHR and the Venice Commission recommend that the law be amended to require that a different judge is assigned to a case that is a review of a commission decision in which the regular municipal judge participated as a member.
