Q. Determination of election results


Article 62(3)(1) of the draft law retains the provision stating that nominated candidates “cannot be candidates for elective posts” in repeat elections held because “elections failed” due to more votes against all candidates than in favour of any candidate. As previously noted by the OSCE/ODIHR and the Venice Commission, this provision is an unreasonable limitation on candidacy and is contrary to the principle of universal and equal suffrage. The OSCE/ODIHR and the Venice Commission recommend this provision be amended to allow “losing” candidates to compete in repeat elections.
