Paragraph 15

III. DISCUSSION OF THE DRAFT NATIONAL ELECTIONS LAW AND THE DRAFT ELECTION COMMISSIONS LAW

A.  Electoral System for Parliament

The Venice Commission has previously stated concerning the electoral system for parliament:

The prohibition of a single party from having more than 65 out of 120 deputies should avoid the domination of one political party. Such a restriction on the size of the majority seems to be new. The problem is that it might violate the principle of the equality of votes. The votes for a party, which has already reached the relevant quota, can be lost. But, these restrictions might be justified as measures necessary to build a pluralistic party system. Specific legislation should explain how the remaining votes are distributed.”[1]
