IV. DISCUSSION OF THE DRAFT LOCAL ELECTION LAW


Electoral systems for local elections


Article 49(6) states that “political parties have no right to nominate candidates individuals who are members of other political parties and who are not members of that political party (non-party).” Thus, in order to be a candidate in local government elections in an administrative-territorial unit of more than 5,000, a person must be a member of a nominating political party or seek nomination from a “group of voters”. This is problematic as Article 49(6) does not allow for independent candidates.
