II. Comments on the text of the draft law


Such frequent changes of the electoral system do not contribute to the stability of the electoral legal framework and electoral system. The choice of an electoral system is the sovereign right of each state; however it should be decided and agreed upon through broad and open discussions in the parliament with the participation of all political forces. Since the draft law re-introduces the system used in the 1998 and 2002 parliamentary elections, it should take account of the shortcomings of the electoral process identified by the national and international experts and observers during those elections.[1] The change of the system should not be understood in such a way as to undermine the confidence of the voters, political parties and civil society in the electoral process.


[1] Unfortunately, the local elections organised in 2010 on the basis of a mixed system seemed to repeat some of the problems observed in 1998 and in 2002.
