Paragraph 112

b. Right to stand for election

The provisions of article 23.2 of the Law aiming at the elimination of B-certified subjects from election procedures constitute an interference with the right to be elected as guaranteed in article 45 of the Constitution and article 3 of Protocol No. 1 of the ECHR, which implies subjective rights for both the right to vote and the right to stand for election. The right to stand for election is also guaranteed by article 25 b) of the International Covenant on Civil and Political Rights (hereinafter referred to as ICCPR).
