§ 28

Request for amendments

(1) During the period of public display of the electoral roll, every citizen, on giving his name and residential address, can make written or oral requests for amendments to this register in the office (§ 25, para 2) responsible for the registration of all requests for amendments. This request for amendments can relate to the listing of any person entitled to vote in the electoral roll as well to the deletion from it of the name of a person not entitled to vote.

(2) The requests for amendments are to be made in the respective office before the end of the period for public display of the electoral roll.

(3) When the requests for amendments are in written form, a separate request is to be made for each individual case. When the request relates to the addition of a voter to the electoral roll, all documents necessary for the support of the objection and especially a personal data form (specimen copy in schedule 1 of the Voters’ Index Law from 1973) filled out by the supposed voter, as long as it is not a citizen living abroad, are to be enclosed. When the request demands the deletion of the name of a person not entitled to vote from the electoral roll, the reasons for this are to be stated. All requests, including those who are not sufficiently documented are to be accepted and passed on by the respective office. When the request is signed by more than one person and none of them has been specified as an authorized recipient, it is the one who signed first that receives this function.

(4) Filing requests for obviously wanton reasons is an administrative violation and is punishable by a fine of up to 218 euros. In default of payment the punishment can be a prison sentence of up to two weeks.
