The draft law largely follows the international standards detailed in this section, and therefore the joint opinion focuses only on those provisions that require improvement. This Joint Opinion analyses the draft law from the viewpoint of its compatibility with international standards on political parties, as well as OSCE commitments. International standards relevant to political parties and election campaigns are found principally in Article 25 of the ICCPR and Article 11 of the ECHR, which both protect the right to freedom of association. The right to free elections guaranteed by Article 3 of the First Protocol to the ECHR is also of relevance. The Joint Opinion further takes into consideration OSCE commitments, as set out, among others, in the 1990 Copenhagen Document; in particular on the protection of the freedom of association (para 9.3), on the right of individuals and groups to establish political parties or other political organisations (para 7.6), on the need to conduct political campaigning in a fair and free atmosphere (para 7.6) and on unimpeded access to the media (para 7.8).
