Article 34 of the draft law on the prohibition of activities of a political party must be read in connection with Article 80 of the Law on the Constitutional Court, which provides clear grounds for debating and deciding on the prohibition of a political party. Thus, the grounds for prohibiting political parties seem to meet the standards stated by the Venice Commission in the Guidelines on prohibition and dissolution of political parties and analogous measures. According to their para. 3, “prohibition or enforced dissolution of political parties may only be justified in the case of parties which advocate or use violence as a political means to overthrow the democratic constitutional order, thereby undermining the rights and freedoms guaranteed by the constitution”. This is also in line with the Opinion issued by the Venice Commission on the Constitution of Armenia.
