In conformity with the Constitution (Article 78.3-4), the draft law provides that a candidate has to receive at least 50 per cent of the valid votes to be elected in the first round. Otherwise, a second round takes place between the two candidates having received the highest number of votes in the first round (Article 109 of the draft law). The stipulation in Article 109.5 that “the votes cast for one candidate shall be considered to be expressed against the other candidate” requires review or clarification, as it does not appear to fit with the chosen electoral system.
