A new Article 31(28-c) states that the SEC provides access to the voter lists in line with the Law on Protection of Personal Data of Citizens. However, the issue of clarifying for what purposes the data in the voter lists can be used has not been addressed. Article 55(1) states that personal data contained in the voter lists cannot be used for any purpose other than “exercising the citizen’s right to vote”. However, Article 55(2) requires the SEC to supply all of the data from the voter lists to any registered political party or independent candidate, upon request. The legal framework should clearly state the permitted use of information obtained from the voter lists and whether the information can be used for the campaign activities of political parties and candidates. As previously recommended, more guidance should be provided to electoral contestants by providing a concrete definition for the term “exercising the citizen’s right to vote.”
